This week’s “Wall of Shame” recognition goes to Palm Beach County Florida, where fraudulent adult guardianships thrived for decades. Judges Martin Colin, David French used to award them before retiring and Judge Sarah Willis continues sponsoring the predators.
Ashley Crispin Ackal, Brian O’Connell, and Amy Nicol, “professional” guardianship lawyers have been in practice for many decades. Ackal and O’Connell were the principal counsel for Curtis Rogers (a professional guardian who still operates in Palm Beach County) when they lost a federal breach of fiduciary obligation lawsuit worth $16.4 million in 2017. This was in connection with the fraudulent adult guardianship case of Oliver Bivins.
Amy Nicol collaborated with Edward Shipe, her attorney and the Florida Department of Children and Families in 1998 to obtain a fraudulent guardianship of Ruth Turgeon (85). Ruth and Mary Morgan, her niece, objected to the transfer of guardianship and were eventually able to do so. However, as soon as Turgeon planned to leave Palm Beach County, the court blocked them from doing so and appointed Nicol as court monitor to decide the suitability and Shipe as attorney ad litem.
Yes, they were the same people who initiated and profited from fraudulent guardianship. The court appointed them to investigate the prevailing guardian. This is unbelievable! Naturally, Turgeon refused to move and Shipe’s and Nicol’s bills were paid out of Turgeon’s estate. The guardianship stayed at Palm Beach County. Morgan and Turgeon appealed this decision to the appellate court, which remanded it to the 15th Circuit for reconsideration. The redo loop cost the Turgeon family more than $100,000 in legal fees. Every attorney wins guardianship, win or lose.
Amy Nicol and Finnish American Village Nursing Home (FAV) in Lake Worth, O’Connell, and Crispin Ackal have teamed up to use adult guardianship in order to collect debt and mitigate risk by FAV under the guardianship and Ilse Schafer. Ilse was the mother of Mrs Florida 2016 Karyn Turk, and she died in suspicious circumstances while under Nicol’s guardianship.
As litigation continues, there is more to come on this case, but unfortunately Palm Beach County continues to embrace predatory lawyers and their intent to estate tradek and condemn loved ones, despite its highly promoted guardianship Frau investigative unit led by County Clerk and Comptroller Sharon Bock, and Deputy Inspector General clerk & Comptroller Anthony Palmieri.
